#KickAssTorrents #Torrents – KickAss Torrents Owner Stays in Prison as Court Denies to Drop Charges : The speculated KickAss torrents owner, Artem Vaulin recently filed a motion to dismiss the charge against him. Nonetheless, he did not succeed as the court denies dropping the charges.
It can be remembered that I was back in July when Artem Vaulin was arrested by Polish law enforcements and is detained in a local prison since then. Last month, he had filed a motion on behalf of his legal defense team pursuing for the U.S. court to terminate the criminal cases against him, Christian Daily had learned.
Artem Vaulin’s defense argument was to simply put it simply operated a search engine that works just like Google, except that KAT “indexes BitTorrent files.” The defense also claimed that torrent files are naturally not illegal; therefore the operation of a torrent search engine such as KickAss Torrents should not be a crime as well.
Additionally, Headlines & Global News reported that a motion was filed on Oct. 17 by defense counsels, Theodore Poulos and Ira Rothken, which stated that, “The fundamental flaw in the government’s untenable theory of prosecution is that there is no copyright protection for such torrent file instructions and addresses. Therefore, given the lack of direct willful copyright infringement, torrent sites do not violate criminal copyright laws.”
Also, Zachary Fardon, the U.S attorney related Vaulin’s motion to that of a drug dealer who needed protection asserting that he had never touched the drug. But then, the U.S. court declined to agree with the argument put out by Poulos and Rothken and it also terminated Vaulin’s motion to dismiss his allegation.
Although the KickAss Torrents owner Artem Vaulin is still behind bars, the alternative torrent sites like The Pirate Bay, 1337X and other are still operating.
